Environmental law

Anyone who wants to construct anything will inevitably have to deal with environmental law. Environmental law includes the topics of spatial planning, the environment, nature and the legislation protecting these, and external safety. Almost all of this is fully regulated in the Environment and Planning Act.

When is this relevant

The Environment and Planning Act determines where construction is permitted, where businesses can be located, how we protect nature and what environmental standards apply. This is relevant if you want to start a business, build homes as a developer, extend a business or change existing construction. But also if there are unwanted plans in your immediate neighbourhood, or if you are a developer looking to build housing. Your plans will then often require an amendment or deviation from the environment plan. Local residents and interest groups or lobbies may object, putting your project at risk.

Nitrogen

A well-known example, of course, is the nitrogen issue. If too much nitrogen deposits on our soil,it can have harmful effects on nature. As a result, permits are increasingly needed. Developments follow each other in rapid succession, making thorough knowledge a necessity.

What we do

We assist both governments and businesses. We do this both for companies that are at the beginning of a process and want to reach an outcome in good consultation with the government, and companies that disagree with government decisions that affect their business activities. We also help companies that have been granted a permit but where local residents litigate to challenge that permit. The stakes are high in these cases. Can you actually complete your project? Will your living environment remain unaffected? Will your permit remain in force or can the court annul it? All this requires specialist knowledge and experience. You can find these at Kienhuis Legal.
