Enforcement

The government can take action against a violation of rules. This can be done via an administrative fine, administrative coercion, an order subject to a penalty for non-compliance, and criminal law. In certain cases, a permit or license may also be revoked. If you are affected by an enforcement decision, we can examine the possible follow-up steps together. This of course also applies if if the opposite situation arises: if you wish to act as a government authority or if you, as an entrepreneur, wish for the government to take action but it refuses to do so. We assist you in this.

Drastic consequences

Enforcement is verifying whether citizens and businesses comply with the rules. It’s not just the police force that effects enforcement, government organisations, the Labour Inspectorate or the Dutch Food and Consumer Product Safety Authority also do so. They impose penalties on citizens and businesses for violations.

Enforcement can have drastic consequences. For example, if an order subject to a penalty for non-compliance is imposed. This may mean that a business has to close down in full or in part. Or a government can apply administrative coercion and demolish a building you have constructed at your expense, because you allegedly do not have a permit that the government says you need.

In many cases, a government authority has the power to impose an administrative fine. The Labour Inspectorate may do so, for example when working conditions legislation is breached. The Labour Inspectorate may even close down your business in case of repeat violations.

What we do

We assist you in proceedings against the enforcing government authority, or as the case may be against the government authority that refuses to enforce its rules. But prevention is better than cure. We help you prevent violations. This comes into play, for example, in the field of working conditions legislation. Following the right procedures and taking the right steps can prevent enforcement. Given the stakes, this is worth pursuing.
