Healthcare providers and healthcare procurement officers such as municipalities, care administration offices, health insurers and other healthcare institutions must make arrangements for the provision of care within the legal frameworks.

Contracting healthcare providers

Consider the Youth Act, the Social Support Act 2015, the Long-Term Care Act and the Mandatory Mental Healthcare Act. The healthcare procurement officers must contract healthcare providers within these frameworks. This is done via a tender procedure, procurement procedure or an open house procedure. The possible procedures and applicable rules depend onwho procures the healthcare andwhat healthcare is procured. This requires thorough preparation and a clear process.

Healthcare procurement under reasonable terms while ensuring quality and access to appropriate care presents a rather complex interplay of forces. In practice, we receive many questions about matters like the design of the procurement procedure, the rate system applied, fair rates, access to certain forms of care, expense claims protocols and of course, the contract conditions.

What we do

We assist both healthcare procurement officers and healthcare providers in the procurement process. Including in drawing up and reviewing tender documentation and procurement policies. But we also offer support when it comes to the summary of additional information and changes, contract term negotiations and assessing and drafting the selection/award decision. There is a lot involved in all this. Our specialists act as interlocutors and advise you on the options available. They also assist procurement officers and healthcare providers in court proceedings, proceedings with the Dutch Healthcare Authority (NZa) and at the Committee of Procurement Experts.
