Education is under enormous pressure due to an increasing shortage of teachers and support staff. Labour Law

Labor Law is comprehensive. There are many rights and obligations for both the employer and the employee that must be taken into account. From the perspective of employer or employee, the questions may of course differ. This includes issues about the Senior Executives in the Public and Semi-Public Sector Standards for Remuneration Act [Wet Normering Topinkomens], but also about dismissal, flexible working, disciplinary measures, the Staff Replacement Fund (Vervangingsfonds) and Collective Redundancy Payments Fund (Participatiefonds) and integrity.


Rights and obligations


Everyone who employs staff will have to deal with labour law. The Dutch Civil Code describes what an employment contract entails and the rules that apply to both employers and employees. In practice, this mainly revolves around hiring and firing of staff. These processes involve many rules and it is important for all involved that this is legally well regulated to avoid (labour) conflicts.


Social security and education


Every school will have to deal with social security rights. This could, for example, be about a sick employee or your own sickness report (Sickness Benefits Act (ZW, Ziektewet) or Work and Income Capacity for Work Act [Wet WIA]), absenteeism and reintegration. But also an employee with unemployment (WW) benefits, the consequences of dismissal, pension issues or a sickness and disability benefit scheme.

Own-risk

We understand that the educational institution is its own-risk bearer for the Unemployment Insurance Act (WW), Sickness Benefits Act (ZW) and Work and Income Capacity for Work Act (WIA). As a result, questions about a sick employee, or an employee whose employment contract is being terminated, require a different approach than when employers are not own-risk bearers.
