Cooperation disputs medical specialist
Nobody wants a dispute, especially not in healthcare. Unfortunately, with all the stakes involved, this can still happen. The organisation of a hospital has special and sometimes complex dynamics. Medical specialists sometimes work as salaried employees and sometimes as freelancers. Because they often work in different teams, friction or even a dispute can arise.
Various interests
Independent medical specialists are often organised in a Medical Specialist Company (MSB, Medisch Specialistisch Bedrijf). In addition, there are separate professional groups, which are sometimes still organised as partnerships, and there is often an Association of Medical Staff (VMS, Vereniging Medische Staf) that has important tasks in the advocacy and representation of the professional group and the quality of care in the hospital. This complexity can cause all kinds of disputes; between medical specialists and departments themselves, between the MSB and the hospital board, or with regard to the performance of individual medical specialists.

What we do
Kienhuis Legal has extensive experience in assisting hospital boards and professional groups/partnerships of medical specialists. This concerns the functioning of individual medical specialists or professional groups and the consequences if this does not go well. The earlier we are involved, the better we can manage for a good outcome, without reputational damage or negative impact on the quality of care.
We aim to bring interests closer together outside the courtroom. If necessary, we carry out procedures to ensure that a dispute is resolved. We increasingly engage (external) mediators in this process. This can prevent parties from becoming further entrenched and a conflict becoming increasingly personal.
