Health Law

Healthcare in the Netherlands is under enormous pressure. There are too few staff and the work is only increasing. And this will be no different in the future. On the one hand, the healthcare sector is expected to hold its own in the free market. On the other hand, the government and health insurers are still interfering in healthcare in detail. Consequently, laws and regulations are extensive and there are several supervisory bodies. Kienhuis Legal keeps an overview in this maze of rules so that you can keep the focus on providing care.

Regulation and supervision

Just as there are many regulations in healthcare, there are also various forms of supervision, including the Health and Youth Care Inspectorate (IGJ, Inspectie voor de Gezondheidszorg en Jeugd), the Dutch Healthcare Authority (NZa, Nederlandse Zorgautoriteit), the Dutch Data Protection Authority (AP, Autoriteit Persoonsgegevens) and the Netherlands Authority for Consumers & Markets (ACM, Autoriteit Consument en Markt). They oversee compliance and application of the regulations. In the process, patients have also become more articulate and have high(er) demands on the availability and quality of care.

This means that the healthcare sector has to deal with complex issues that may relate to the Health Insurance Act [Zorgverzekeringswet], the Long-Term Care Act [Wet Langdurige Zorg], and the Social Support Act [Wet maatschappelijke ondersteuning]. But also government regulation, such as in the Healthcare Market Regulation Act [Wet Marktordening Gezondheidszorg]. And an increasing number of complaints and disputes, such as disciplinary complaints and the proper structure of the healthcare organisation (governance). And the ongoing challenge of ensuring that patient care does not suffer.

What we do

Kienhuis Legal's clients are logically faced with this increased regulatory burden. This is visible in the accountability they have to render to the supervisory bodies and in obtaining the required permits to be able to (continue to) provide healthcare. For example, we assist our clients in obtaining WTZa permits, setting up client participation, when there are incidents or emergencies in healthcare, and drawing up collaboration agreements between institutions or professional groups.

The health law lawyers at Kienhuis Legal have extensive experience in assisting, for example, hospitals, VVT institutions, institutions for disability care and youth care, as well as sector organisations, municipalities and individual professionals. They provide the legal support necessary so that patient care can come first.
