Payment is not forthcoming
An organization's account receivables department is the first to notice that invoices are not being paid. Of course these debtors are reminded of payment and, where possible, pick up the phone or start the conversation. After all, disrupting the good relationship is not the intention. Sometimes the problem turns out to be of a financial nature and a payment agreement can be made in good consultation. But what happens if the debtor remains negligent?
Debt collection by Kienhuis Legal
Employees of Kienhuis Legal can take over the debt collection from you. Private debtors first receive a so-called 14-day letter, in which we give them notice of default and offer them one more opportunity to pay the invoice without additional collection costs. If payment is not forthcoming, we will send the debtor a demand letter in which we make it clear to the debtor that this is the last letter before we proceed to take legal measures.
If your debtor is not a private individual, but acts on behalf of an organisation, we will immediately send them the demand letter. The 14-day letter is not necessary in this case. The collection agents will also contact the debtor by telephone to find out why the invoice is not paid.
The debtor may not be able to pay the claim in one go. We will then try to come to a payment arrangement with your debtor that is satisfactory for you. The approach is of course always that your debtor pays in one go. If, despite everything, payment is not forthcoming, we can proceed to take legal measures in consultation with the client. In that case, we will start legal proceedings before the competent court. We engage our specialised lawyers for the legal proceedings.

What does the monetary claim consist of and how can you pay it?
The collection and demand letters sent by Kienhuis Legal explain how the total monetary claim has been estimated. Usually it will concern one or more main claims, for which extrajudicial costs and statutory (commercial) interest are also claimed.
The letter states how you can pay the claim. In general, you will be able to transfer the money to the escrow account of Kienhuis Legal, with a payment reference stated in the letter.
